Most Realtors act as “transaction brokers.” A transaction broker is a Realtor that does not represent either party in a fiduciary capacity or as a single agent.
In 2008, the law in the State of Florida changed resulting in Florida becoming a “transaction broker” state by default. This means Realtors who act as transaction brokers no longer have to put their real estate clients on notice that the relationship between the Realtor and the client is of limited representation and limited confidentially.
If your Realtor does not specifically address his or her duties to you then the law assumes the Realtor is acting as a transaction broker. A Realtor acting as a transaction broker is not looking out for either party’s best interest but participates only to facilitate the transaction.

Even if your Realtor is acting as a single agent, keep in mind that Realtors only get paid when a transaction closes. This potential scenario may result in a detriment to you.
