Understand the Contract Before You Sign It

Signing a real estate contract that you do not fully understand can bring you unforeseen consequences and may prevent a property from closing at the last minute.

Whether you are an inexperienced first time home buyer or selling one of your multiple investment properties, you should ensure that you understand every word of the contract before you sign it. Our real estate attorneys will take the time to explain each clause of the contract and answer all your questions thoroughly before you place your signature on any document. Contact our law firm today to review your real estate contracts with us before signing them.

Is Your Realtor a “Transaction Broker”

You may have a Realtor assisting you with the process. If so, do you understand the type of relationship you and your Realtor have?

Is your Realtor acting as a single agent or a transaction broker? How do you know your Realtor is looking out for your best interest?

Most Realtors act as “transaction brokers.” A transaction broker is a Realtor that does not represent either party in a fiduciary capacity or as a single agent.

In 2008, the law in the State of Florida changed resulting in Florida becoming a “transaction broker” state by default. This means Realtors who act as transaction brokers no longer have to put their real estate clients on notice that the relationship between the Realtor and the client is of limited representation and limited confidentially.

If your Realtor does not specifically address his or her duties to you then the law assumes the Realtor is acting as a transaction broker. A Realtor acting as a transaction broker is not looking out for either party’s best interest but participates only to facilitate the transaction.

Regardless of the type of relationship you have with your Realtor, a conflict of interest may exist. Even if your Realtor is acting as a single agent, keep in mind that Realtors only get paid when a transaction closes. The fact that Realtors only earn their commission at closing may create a conflict of interest as your Realtor has an incentive to persuade you to act in an attempt to close a transaction for the Realtor’s financial benefit. This potential scenario may result in a detriment to you.
