Doctor Sued For Medical Malpractice Over Fatal Accident
Just over two years ago, a truck ran over two children, killing them. As a result, their parents filed a medical malpractice lawsuit against a doctor.
You may be wondering why. How did an auto accident lead to a doctor being sued? It has to do with the driver’s doctor allowing the man to drive despite medical issues.
The fatal accident occurred on December 4, 2020. A restaurant owner was driving a truck when it jumped the curb and ran over two children. The kids were playing mini golf at Coconut Creek Family Fun Park in Panama City Beach as their parents watched in horror.
The truck hit a 6-year-old girl and a 4-year-old boy. Their parents recently announced that they would be suing the driver’s doctor for medical malpractice, and here’s why.
The man has poor medical and driving records that include 12 hospitalizations, five car accidents, and multiple occasions of noncompliance with seizure medications. Given this information, the man should not have been driving. What’s so upsetting to the children’s parents is that the accident could have been prevented.
The man’s toxicology report showed no trace of alcohol or drugs. It is believed that he had a seizure, likely due to his history of alcohol abuse. He does not have epilepsy, a congenital condition, or any disease that would cause seizures.
Instead, the man allegedly stopped drinking and was having withdrawals at the time of the accident. That was likely why he had a seizure.
Complicating matters is the fact that the man’s doctor knows about his alcoholism and how it is affecting him medically. However, the doctor keeps telling the man that his problems are not related. In fact, the doctor has tried to hide the man’s medical condition from other medical personnel.
The man has been hospitalized multiple times and each time, the doctor would be there to say it is not alcohol-related when it clearly is.
The lawsuit names the doctor, the driver, and his restaurant, called “Billy’s Oyster Bar.” According to the lawsuit, employees knew that the man had an alcohol problem but continued to serve him.
This is a unique case in which a car accident has led to a medical malpractice case. Medical malpractice typically occurs in a clinic or hospital environment and is not generally related to auto crashes. This is a rare situation in which two areas of law come together.
