Is Sealing Of Criminal Records Automatic In Florida?

Well, it doesn’t. In the vast majority of cases, sealing or expunging criminal records in Florida is not automatic. You’ve got to earn it. But there are rare cases that do bypass the courtroom.

What Is Automatic Sealing and When Does It Actually Happen?

Florida law, under Florida Statutes § 943.0595, does allow for automatic sealing but only in narrow circumstances. If the criminal history record stems from a case where no charging document was filed (like a misdemeanor that never resulted in an indictment) or the charges were dismissed, dropped (nolle prosequi), or acquitted in court, the Florida Department of Law Enforcement may automatically seal that record. If this happens, it means no court petition needed.

But here’s the thing: this isn’t the default. FDLE reviews and identifies eligible cases and acts. And it acts not in real time, but on its administrative schedule. The seal has the same effect as court-ordered sealing, though it may take longer to process.

Why Most People Still Need a Court Order

And guess what? Most arrests don’t qualify for automatic sealing, even if you weren’t convicted. If you were adjudicated delinquent, found guilty, or had adjudication withheld, Florida doesn’t grant the seal automatically. You’ll need to follow formal steps:

  1. Apply to the Florida Department of Law Enforcement for a Certificate of Eligibility.
  2. Petition the court for a sealing or expungement.
  3. Attend hearings and share supporting documents (don’t just wait and do nothing).

Only after all that can a judge decide if your record should be sealed or expunged.

Juvenile Records: Some Hope, But Still Not Truly Automatic

If you were arrested as a minor in Florida, there are more direct routes to sealing:

Under Section 943.0515, juvenile records may be automatically expunged at age 21 if certain conditions are met, like no adult arrests or convictions pending. That’s a rare lifeline—but again, you won’t feel it unless you check your record.

Why People Think Sealing Is Automatic

It’s easy to assume that dropped charges mean your digital footprint vanishes, especially with Google search results and background checks. But that illusion can come back to haunt you. Employers, housing agencies, and landlords often rely on long-standing database results, not court systems.

Even auto-sealed or expunged records can linger in private search engines, social media snapshots, and third-party aggregators. The system doesn’t erase your digital history. It’s only the legal records.
