Teacher Killed In Crash Involving Police Officers

A horrific car accident in Miami has seriously damaged vehicles and caused fatal injuries. The fatal crash happened on the evening of January 2 on Hialeah Drive by 5th Avenue. The crash, which sounded like an explosion, injured two police officers and killed a popular math teacher. The 51-year-old teacher taught at a Miami design and architecture senior high school known as DASH.

The accident caused damage to Charlie’s Ice Cream Shop. The car with the police officers had slammed into the front wall. After the crash, there were three fire trucks and 40 cars at the scene. The injured police officers were taken to Jackson Memorial Hospital and were released the following morning.

The details of the crash are unknown. It has been classified as a traffic accident, but it is unknown how the accident occurred. Police is currently reviewing a surveillance video from a nearby business that caught footage of the crash. The Miami-Dade State Attorney’s office is monitoring the case.

Elements of a Wrongful Death Case

Depending on who caused the crash, the family of the math teacher may be able to file a wrongful death claim against the liable party. A wrongful death claim must include four elements:

  • It must be proven that the person’s death was caused by someone else’s negligent or reckless behavior.
  • Breach of duty. It must be proven that the person owed the victim a duty and that duty was breached. For example, a motorist has a duty to drive in a safe manner. When a motorist fails to follow traffic laws, he or she breaches a duty.
  • It must be proven that the breach of duty directly caused the victim’s wrongful death.
  • The person’s death must have led to damages for the surviving family members. Damages may include medical bills, funeral expenses and loss of income.

Who Can File a Wrongful Death Claim?

Only close family members can file a wrongful death claim, so aunts, uncles and distant cousins would not be able to recover compensation. Those who would be able to file a claim include the victim’s spouse, domestic partner, children, parents or a minor who depended on the victim for support. The man in this case took care of his disabled sister and helped care for his nieces and nephews, who lost their mother at a young age. It is possible that they may be able to file a claim and receive compensation for the damages they suffered due to their family member’s untimely death.
