Florida Man Files Medical Malpractice Lawsuit After Wife’s Death

medical malpractice

Doctors are only human, so they make mistakes just like everyone else. However, their mistakes can be serious in nature, and even deadly.

While most doctors strive to provide a high standard of care for their patients, medical malpractice occurs at high rates. It is the third-leading cause of death in the United States, accounting for more than 200,000 deaths every year.

The husband of a woman who was allegedly killed by medical negligence several years ago is currently fighting his case in Florida courts. The man is claiming that medical staff failed to provide his wife with an acceptable standard of care. He is suing Radiology Associates Clearwater, M.D., PA and Morton Plant Hospital Association for breaching their standard of care.

In August 2014, the woman was admitted to Morton Plant Hospital in Clearwater after suffering multiple ailments, including hepatic encephalopathy (worsening of brain function due to a damaged liver), deconditioning syndrome (decrease in the responsiveness of heart muscle), disuse myopathy (weakening muscles) and difficulty swallowing.

She was evaluated, treated and discharged. However, she continued to suffer organ failure. She died on September 25, 2015. Her husband alleges that a lack of safe patient care led to injury, which worsened her condition. He also claims that the nursing staff was neither professional nor adequate enough to care for his wife’s needs.

The man is seeking a trial by jury. The exact sum he is asking for has not been disclosed, but it is more than $15,000.

What to Know About Medical Malpractice

Medical malpractice is a costly mistake. It not only leads to worsened health, but death as well. It costs several billions of dollars every year.

Medical malpractice occurs when a doctor deviates from the standard of care. There is no black and white when it comes to determining standard of care. That is why expert witnesses are important in these cases. The experts are doctors who practice the same type of medicine as the defendant and have many years of experience. The judge and jury will base their decision on this person’s expertise and opinion.

But that’s not the only thing that must be proven. The standard of care must have also led to injuries and damages. If the doctor makes a mistake but nobody was hurt, then there is no medical malpractice case. The injury must have led to damages such as medical expenses, lost wages, or pain and suffering.
